Agreement to Terms

By accessing or using Cilbup ("the Service", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Description of Service

Cilbup is a privacy-first platform that allows:

• Creators to receive anonymous messages from fans
• Fans to send optional tips with messages
• Creators to manage messages and withdraw earnings

Tips are priority signals — they help creators identify serious questions and may increase the likelihood of a response. However, tips do not guarantee a reply.

Eligibility & Age Requirements

Age Requirements

• Messaging features: You must be at least 18 years old to use Cilbup
• Payment features: You must be at least 18 years old to send or receive tips

By using Cilbup, you confirm that:

• You are 18 years of age or older, OR
• You are using the platform with the consent and supervision of a parent or legal guardian

We do not knowingly collect personal data from individuals under 18. If you believe a minor is using Cilbup without proper consent, please contact us immediately.

Additional Requirements

You must:

• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and truthful information

Account Registration

Creating an Account

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Account Security

You agree to:

• Choose a strong, unique password
• Not share your login credentials with others
• Log out from your account when using shared devices
• Update your account information to keep it accurate

User Conduct

Prohibited Activities

You agree NOT to:

Harassment & Abuse

• Send threatening, abusive, or harassing messages
• Bully, intimidate, or harm others
• Engage in hate speech or discrimination

Illegal Content

• Share illegal content or promote illegal activities
• Post content that violates copyrights or trademarks
• Distribute malware or harmful code

Fraud & Deception

• Impersonate other individuals or entities
• Create fake or misleading profiles
• Engage in fraudulent transactions

Platform Abuse

• Attempt to hack, overwhelm, or disrupt the Service
• Use bots or automated tools without permission
• Circumvent security measures or rate limits
• Scrape or harvest user data

Inappropriate Content

• Post explicit content involving minors
• Share non-consensual intimate images
• Promote self-harm or violence

Anonymous Messaging

How Anonymity Works

• Messages sent through Cilbup are anonymous to recipients
• We do not share sender information with message recipients
• We may retain technical data (such as IP addresses) to prevent abuse and comply with legal obligations
• Anonymity does not protect illegal behavior — we may cooperate with law enforcement when legally required

Recipient Rights

Message recipients may:

• Read, archive, or delete messages
• Report messages that violate these Terms
• Enable minimum tip requirements to filter messages

Tips and Payments

Currency Support

Currently, Cilbup only supports Nigerian Naira (NGN) for:

• Receiving tips
• Processing payouts/withdrawals

We may add support for additional currencies in the future.

Tipping Limits

To prevent abuse and comply with regulations:

• Minimum tip: ₦500 (or as configured by the creator)
• Maximum single tip: ₦500,000
• Maximum tips per creator per day: ₦1,000,000 (aggregate)

These limits may be adjusted and are subject to change.

Payment Processing

• Tips are processed securely through Paystack
• Cilbup charges a platform fee on tips (currently ~10%) to cover payment processing and infrastructure
• Payment provider terms also apply to transactions
• All payments are subject to Paystack's verification and security measures

No Guaranteed Response

Sending a tip does not guarantee a response from the creator. Tips are voluntary contributions that signal priority and support creators. Creators have no obligation to respond to any message, with or without a tip.

Refund Policy

Tips are generally non-refundable once sent.

We understand mistakes happen. Refund requests will be considered on a case-by-case basis for:

• Technical errors: Payment processed but message not delivered
• Duplicate charges: Same tip charged multiple times
• Unauthorized transactions: Fraudulent use of payment method (with valid evidence)

Refund requests will NOT be granted for:

• Sender's regret or change of mind
• Creator not responding to message
• Message content errors
• Disagreement with creator's response (or lack thereof)

To request a refund, contact us within 7 days of the transaction with your transaction reference and explanation.

Chargebacks without valid cause may result in immediate account suspension.

Earnings & Withdrawals

• Creator earnings are held in your Cilbup balance
• Payouts are processed via Paystack to your linked Nigerian bank account
• Minimum withdrawal: ₦5,000
• Withdrawals are subject to our review and may require identity verification for large amounts
• Withdrawal requests are typically processed within 24-48 hours on business days

Automatic Monthly Payouts: At the end of each month, if your balance exceeds the minimum threshold, we may automatically process a payout to your linked bank account.

Platform Fees

Cilbup charges a platform fee on all tips to cover:

• Payment processing fees
• Infrastructure and hosting
• Platform development and maintenance

The fee is deducted before earnings are credited to your balance. Current fee: approximately 10% of tip amount.

Intellectual Property

Our Content

• The Service, including design, logos, and features, is owned by Cilbup
• You may not copy, modify, or distribute our content without permission

Your Content

• You retain ownership of content you create and submit
• By submitting content, you grant us a license to display and distribute it on the platform
• You represent that you have the right to share any content you submit

Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand our data practices.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• Results obtained from using the Service will be accurate
• Creators will respond to messages

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruption or data loss
• Actions of other users or third parties
• Content of messages sent through the platform
• Creator responses or lack thereof

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or ₦50,000, whichever is less.

Indemnification

You agree to indemnify and hold harmless Cilbup, its officers, directors, employees, and agents from claims, damages, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit to the Service
• Messages you send through the platform

Termination

By You

You may terminate your account at any time through your account settings or by contacting us.

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse other users or the platform
• Request account deletion

Effect of Termination

Upon termination:

• Your right to access the Service ends immediately
• Pending withdrawals may be processed or withheld depending on circumstances
• We may delete your data according to our retention policy
• Provisions that should survive termination will remain in effect

Funds Upon Termination

If your account is terminated:

• For violation of Terms: Funds may be withheld pending investigation
• By your request: Outstanding balance above minimum threshold will be paid out within 30 days to your linked bank account

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on the Service
• Sending an email notification
• Displaying a notice when you next log in

Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

1. Informal Resolution: Contact us first to attempt to resolve the dispute informally
2. Mediation: If informal resolution fails, we may agree to mediation
3. Arbitration or Court: Disputes not resolved through the above may proceed to binding arbitration or Nigerian courts, as permitted by law

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cilbup regarding the Service.
